A proposed class action out of Wisconsin claims Associated Collectors, Inc. violated the Fair Debt Collection Practices Act (FDCPA).
A proposed class action out of Wisconsin claims Associated Collectors, Inc. violated the Fair Debt Collection Practices Act (FDCPA) by attempting to slide additional fees onto all debt payments made with a credit or debit card. The problematic (and allegedly unlawful) language included by the defendant in the plaintiff’s collection letter said: “A fee of 3% of the transaction amount or $25.00, whichever is less, may, as permitted by law, be added to all payments made by credit card or debit card.”
The plaintiff argues that no agreement was made authorizing such fees.
