A class action filed in New York alleges Asset Recovery Solutions denied consumers their right to dispute debts, among other ostensible FDCPA violations.
A proposed class action lawsuit has been lodged against Asset Recovery Solutions, LLC on behalf of New York consumers exposed to the defendant’s allegedly illegal debt collection activity. According to the suit, Asset Recovery Solutions improperly denied these individuals their right to dispute a debt and sent collection notices that violated certain provisions of the Fair Debt Collection Practices Act. Specifically, the 12-page complaint alleges the defendant would not accept disputes verbally – that is, over the phone – and illegally required reasons for consumers’ disputes. The lawsuit further claims that the defendant instilled a false sense of urgency in its collection letters by stating that proposed settlement offers would be taken off the table if the alleged debtor failed to comply with certain outlined terms. This, the suit claims, is all despite the fact that Asset Recovery Solutions would “always entertain the offered settlement.” Lastly, the defendant allegedly made contradictory statements regarding interest and fees and failed to clearly and accurately identity the creditor in its letters.
