A New York consumer claims that ARStrat sent her two letters that confused her as to the expiration date of her 30-day validation period.
ARStrat, LLC is on the receiving end of a New York woman’s proposed class action in which she alleges the debt collector sent her two letters that confused her as to the expiration date of her 30-day validation period.
According to the case, the defendant sent a letter to the plaintiff in September 2018 that stated:
“We sent you a first notice which included your rights under the Fair Debt Collection Practices Act. You still have time to exercise your rights.”
The case says the notice then included a disclosure stating the woman’s FDCPA rights—namely, that she had 30 days to dispute the debt before the debt collector would assume its validity. The suit argues that it was “unclear” whether a new validation period commenced from the date of the second letter or if the original deadline was to be followed.
