The November 2017 notice allegedly claimed to be the second notice sent to the plaintiff regarding the obligation:
“We sent you a first notice which included your rights under the Fair Debt Collections Practices Act.
You still have time to exercise your rights.”
The plaintiff claims he did not receive any other notice from the defendant and was left unsure as to when his right to dispute the debt or request validation would expire.
