ARS National Services, Inc. is facing a New York consumer’s claims that the debt collector violated the Fair Debt Collection Practices Act by failing to clearly communicate in a collection letter the amount of her alleged debt.
ARS National Services, Inc. is facing a New York consumer’s claims that the debt collector violated the Fair Debt Collection Practices Act by failing to clearly communicate in a collection letter the amount of her alleged debt. In a proposed class action lawsuit, the plaintiff says she received a letter from ARS National Services that listed her account balance and informed her that the amount “is subject to change, including possible increases due to interest and other charges.” The suit argues that this language is misleading because it fails to provide any specific information about the nature and timing of any additional charges, including the interest rate, and leaves the plaintiff unsure as to the true amount of her alleged debt.
