A proposed class action claims that ARS National Services Inc. sent a collection letter that included ambiguous language concerning whether interest and other charges were accruing on the plaintiff’s Citibank account.
Filed in New York, the suit says the notice left the plaintiff unsure as to what he would need to pay to resolve the debt as it stated, in part:
“Please be advised that your account balance stated above is subject to change, including possible increases due to interest and other charges according to the terms of your original credit agreement.”
The case says that this vague statement failed to convey whether the debt amount would actually increase and did not explain the basis for calculating any potential interest or fees. Consequently, the complaint argues, the plaintiff was uncertain as to whether paying the minimum amount due would prevent additional charges or if the debt amount would still be subject to increase until the full account balance was paid.
