A new class action out of New Jersey claims collection agency ARS National Services unlawfully sent debt collection letters to consumers.
A new class action out of New Jersey claims collection agency ARS National Services unlawfully sent debt collection letters to consumers. According to case documents, the defendant sent the plaintiff a collection letter for a defaulted debt reportedly owed to Capital One Bank, N.A. that included a deceptive settlement offer that could lead the unsophisticated consumer to be confused about his or her rights and consequences of accepting a deal that could have tax consequences.
The case says the defendant “attempted to entice [the plaintiff] and other similarly into accepting the settlement offer by explicitly representing a specific savings amount when the defendant knew that the savings offer was a false, deceptive or misleading representation.”
Individuals covered by the proposed class include anyone in New Jersey who received a letter from ARS National Services concerning a debt owned by Capital One Bank, N.A. that contained the abovementioned FDCPA violations.
