ARS National Services Inc. is the defendant in a proposed class action that alleges it ran afoul of the Fair Debt Collection Practices Act (FDCPA) in the course of its conduct with consumers. The two named plaintiffs behind the suit claim the defendant sent them collection notices that unlawfully failed to disclose whether their balances could increase due to accrued interest or fees. This conduct, the case alleges, could cause the unsophisticated consumer to be unsure as to whether payment of the balance listed would satisfy the debt.
