A New York consumer claims in a lawsuit that ARS National Services unlawfully left out of a collection notice information necessary to accurately determine the amount of debt owed. The case claims ARS violated the Fair Debt Collection Practices Act (FDCPA) by stating in the notice—a copy of which is included in the complaint below—that the plaintiff “will save $5,583.37” should the individual pay $6,382.26 on a debt of only $798.89. According to the lawsuit, the letter never explained why the defendant would be demanding such a high payment on a debt of approximately $800.
“The letter…did not convey ‘the amount of the debt’ without ambiguity from the perspective of the least sophisticated consumer,” the lawsuit reads.
