A proposed class action has been filed against ARS National Services, Inc. claiming the debt collector misled a New York consumer regarding the amount of her alleged debt.

A proposed class action has been filed against ARS National Services, Inc. claiming the debt collector misled a New York consumer regarding the amount of her alleged debt. The plaintiff says she received a collection letter from ARS that contained the following statement:
While your account is with our office, if you pay $2,382.93, the above-referenced account will be considered paid in full.”
Though the letter purports to clearly state the plaintiff’s amount of debt, the suit argues, it fails to indicate whether her balance will increase if the account is not “with [the defendant’s] office.”
“The Letter intimates that the balance will increase if Defendant does not have the account,” the complaint explains, adding that the above statement “creates the false impression” that the plaintiff must pay off the indicated amount or risk having to pay more later due to added interest or fees.
