Arrowhead Bottled Water Contains Microplastics, Class Action Lawsuit Claims

A proposed class action lawsuit alleges the Arrowhead-brand bottled water sold by BlueTriton Brands is falsely and misleadingly labeled since the “100% Mountain Spring Water” contains microplastics.

The 40-page BlueTriton lawsuit contends that reasonable consumers do not expect microplastics to be found in a product touted as “100% Mountain Spring Water.” The case accuses defendant BlueTriton Brands of impairing the ability of the plaintiff and other consumers to choose the type and quality of the products they aim to buy, namely by fraudulently mislabeling Arrowhead bottled water.
“Microplastics contamination is a material concern to Plaintiff and other reasonable consumers,” the complaint states. “Bottled water that is contaminated with microplastics is not 100% Mountain Spring Water.”
Microplastics are minuscule particles that originate from the manufacture and physical degradation of plastics, the suit explains. Microplastics can take the form of “a variety of different molecules with different structures, shapes, sizes, and polymers” and are typically made from polypropylene, polyethylene, polystyrene or other synthetic polymers, the lawsuit relays.
With regard to bottled water, the complaint shares that microplastics can “leach into the water from the bottle,” exposing consumers to “additives, processing aid, and unreacted monomers” and possibly contributing to gastrointestinal issues, endocrine disruption and cardiovascular problems.
“After being absorbed, Microplastics have the potential to be transported through the circulatory system and subsequently accumulate in various organs, including the kidney, gut, and liver. Thus, the effects on several blood and the immune system cell lines have been widely reported for several Microplastics. Moreover, Microplastics exhibit a ‘Trojan Horse’ effect by absorbing and transporting various environmental pollutants.”
As a result of the apparent mislabeling of the BlueTriton products at issue, proposed class members have been misled into buying water that fell short of providing them with the benefit of the bargain they paid for, the filing stresses. Worse than the lost money, the case goes on, Arrowhead bottled water buyers have been deprived of their right to “choose the type and quality of the products they ingest.”
The lawsuit looks to represent all persons in the United States who bought Arrowhead bottled water within the last four years.
