A proposed class action alleging violations of the Fair Debt Collection Practices Act (FDPCA) has been filed in New Jersey against Armand Law Group.
A proposed class action alleging violations of the Fair Debt Collection Practices Act (FDPCA) has been filed in New Jersey against Armand Law Group, PLLC and Aargon Agency, Inc. Summarily, the case takes issue with the defendants’ alleged practice of sending to New Jersey consumers collection letters that demand payment for debt amounts that include interest that neither Armand Law Group nor Aargon Agency are entitled to collect.
According to the lawsuit, proposed class members were sent collection notices that demanded interest be paid to the defendants even though neither they nor the attorneys whose names were on the notices were licensed to practice law in New Jersey at the time the notices were sent. Moreover, the case claims the notices’ mention of attorney involvement when there was none “would confuse the least sophisticated consumer as to whether defendant Armand Law Group was meaningfully involved in the matter as an attorney, and if so, to what degree.”
“Within the last year, [the defendants] sent collection letters to numerous New Jersey consumers falsely implying or threatening legal action, although neither [the defendants] nor any attorneys in their office were licensed in the State of New Jersey,” the complaint reads.
