Arkansas Plaintiff Claims He Was Illegally Arrested by ‘Uncertified’ Police Officer

Duncan v. Sanders
Filed: October 4, 2017 ◆§ 2:17-cv-00179-KGB
An AR man has filed a proposed class action against an individual the lawsuit claims poses as a certified police officer and has made a number of illegal arrests.
A proposed class action alleges defendant Cliff Sanders, individually and in his official capacity as a police officer for the cities of Elaine and Helena-West Helena, Arkansas, has been acting as a “certified police officer” for the past three years even though, as the lawsuit claims, he “is not, and has not been, a certified police officer.” The plaintiff alleges the defendant illegally arrested him “on multiple occasions” for arson “using more force than was reasonably necessary.” According to the lawsuit, during one incident, after the plaintiff supposedly invoked his Fifth Amendment rights, the defendant “slammed [him] to the ground in retaliation and pepper sprayed [the plaintiff].” The plaintiff claims the defendant has arrested hundreds of people illegally.
