Kempton v. Life For Relief And Development
Filed: October 31, 2018 ◆§ 3:18cv13404
Life for Relief and Development is facing a lawsuit that claims the non-profit international aid organization sent unwanted promotional text messages.
Michigan
Life for Relief and Development is on the receiving end of a proposed class action wherein a consumer alleges the non-profit international aid organization sent unwanted promotional text messages to his cell phone.
The plaintiff alleges that he began receiving automated texts from the defendant in 2017 in which the organization solicited donations and advertised its website. The man claims he received approximately 20 messages from the defendant despite never providing permission to be contacted and having no prior relationship with the organization.
The case goes on to allege the plaintiff replied “Stop” to several of the texts but continued to receive more messages. The man supposedly went on to call the defendant directly and spoke to a receptionist who said the they “could not remove his phone number from their system, then forwarded Plaintiff to a prerecorded message.”
The suit argues the defendant violated the Telephone Consumer Protection Act (TCPA) by sending the texts without the plaintiff’s permission and continuing to message the man after he attempted to opt out of further communications.
