A settlement has been reached to resolve a proposed class action lawsuit that alleged negligent cybersecurity on the part of Ardagh Glass Inc. resulted in a 2021 data breach that impacted the personal information of approximately 5,300 people.

The deal, which was preliminarily approved by the court on July 11, 2024, covers anyone who received notice from Ardagh that their personally identifiable information may have been compromised as a result of the data breach.
According to the lawsuit against Ardagh, an unauthorized third party gained access to the glass packaging producer’s network between April 23 and May 19, 2021. The incident potentially exposed the names, driver’s license numbers, Social Security numbers and financial account information of current and former employees, the data breach suit relayed.
To receive Ardagh settlement benefits, class members must file a valid claim form online or by mail by November 27, 2024.

In order to file a claim online, you will need your unique Class Member ID, which is typically found on the personalized notice issued to class members to inform them about a settlement, the website says.
As part of the deal with Ardagh, eligible class members who file a timely, valid claim form may receive three years of complimentary credit monitoring and identity theft protection services, the site shares.
In addition, class members can make a claim for reimbursement of out-of-pocket losses that were incurred between April 23, 2021 and August 29, 2024 and are reasonably linked to the data breach, for up to $11,000 per person, the website states.
Per the site, eligible consumers may also submit a claim for compensation for up to five hours of lost time spent dealing with the consequences of the incident, at a rate of $25 per hour, and subject to the $11,000 per-person maximum.
The website adds that any money remaining in the settlement fund after the payment of all valid claims, administrative expenses and service fees will be distributed automatically to eligible class members. Consumers do not have to file a claim to receive this pro-rated cash payout, the site points out.
Finally, as part of the settlement, Ardagh has agreed to implement and maintain enhanced data security programs and policies to better protect its network in the future, the website describes.
The court held a hearing on November 5, 2024 in Indianapolis to determine whether to grant final approval to the terms of the deal. Settlement benefits will be issued to eligible class members once the deal receives ultimate approval and after any appeals are resolved, the site relays.
