Two companies that operate Apple's Restaurants in Kentucky, Ohio, West Virginia and Virginia have been hit with a proposed class action.
Two companies that operate Applebee's Restaurants in Kentucky, Ohio, West Virginia and Virginia have been hit with a proposed class action over the way they pay some of their employees. According to the suit, Employee Resource Group, LLC and WV Neighborhood Hospitality, LLC pay bartenders, hosts and servers a sub-par minimum wage under the tip credit provisions of federal labor law. The suit says that defendants didn’t pay these workers the difference when their tipped wage and tips didn’t equal the standard minimum wage. Furthermore, the plaintiff claims that she and other employees sometimes performed non-tipped work in excess of 20% of their time and that the companies were not allowed to take a tip credit for this time.
