AP Holdings, LLC and two subsidiaries are on the receiving end of a proposed class action lawsuit claiming they violated the Telephone Consumer Protection Act (TCPA) by placing unsolicited telemarketing calls to consumers’ cell phones using an automated dialing system. According to the suit, the energy providers call potential customers without their consent and attempt to solicit their business. The suit argues that the unavoidable calls were “frustrating, obnoxious, annoying, were a nuisance, and disturbed the solitude” of proposed class members.
