Anytime Fitness has been hit with a proposed class action that alleges the gym chain sent unsolicited promotional text messages en masse to thousands of consumers.
Behind the case is an Arizona resident who alleges he received automated texts that advertised a discounted Anytime Fitness membership. The man was never an Anytime Fitness customer, nor did he provide the company with his cell phone number, the suit alleges. The complaint says the gym chain violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system to contact consumers without first obtaining their written permission to do so.
