Samsung Electronics America, Inc., its foreign parent company, and four major retailers are facing claims that they failed to provide an adequate recall options.
Samsung Electronics America, Inc., its foreign parent company, and four major retailers are once again facing claims that they failed to provide an adequate remedy to consumers who bought the recalled washing machines. The machines were known to “suffer catastrophic failure” during the highest cycles, with Samsung recalling 34 models in November 2016, according to the suit. The full refund provided in the recall allegedly did not apply to the plaintiff and other consumers who had purchased their machines more than 30 days before the recall was issued, and the rebate available to them would supposedly only cover “a fraction” of the price to replace their machines. The plaintiff argues that if one were able to convince Samsung to repair the machine, the retrofit it provided would still not allow all the settings to be used.
The suit argues that the defendants provide no relief to consumers “who have, through no fault of their own, purchased defective and dangerous Samsung washing machines.”
