A consumer claims in a proposed class action that LTD Financial Services, LP offered her a purportedly time-sensitive debt settlement, only no time limit truly existed.
A Wisconsin consumer claims in a proposed class action that LTD Financial Services, LP offered her in a collection notice a purported settlement that unlawfully implied the deal would only be available for a limited time. This tactic, which the case claims is a violation of the Fair Debt Collection Practices Act (FDCPA), is false and misleading because not only is the offer under no time restriction, it was made in an attempt to impart urgency on the debtor to induce payment, the lawsuit alleges.
The exact language of the purported settlement offer is also at issue in the lawsuit. The case claims the defendant instructed the plaintiff to select a repayment option even though only one option was presented in the collection notice. This wording implies the debtor has a choice of how to repay the debt and is inherently confusing, the complaint argues.
