Blue Ridge Podiatry Associates filed a proposed class action against Annexmed Billing Services Inc. for allegedly violating the Telephone Consumer Protection Act.

Blue Ridge Podiatry Associates, a business located in North Carolina, filed a proposed class action against Annexmed Billing Services Inc. for allegedly violating the Junk Fax Prevention Act (JFPA), an amendment of the Telephone Consumer Protection Act (TCPA). The plaintiff reports receiving unwanted fax advertisements from the defendant without prior consent, which expended valuable resources and time. Additionally, the complaint claims the faxes failed to display an “opt-out” message informing the recipient of its option to no longer receive future faxed advertisements. The suit seeks injunctive relief to discourage the defendant from engaging in future violations and monetary relief of up to $500 per violation.
