An Illinois consumer has filed suit against Sprite Entertainment, Inc. (which does business as Animation Sharks) claiming the defendant sent her an illegal fax advertisement without her prior consent, in violation of the Telephone Consumer Protection Act. According to the complaint, the plaintiff received a fax from the defendant on September 6, 2017 despite not having a prior business relationship with Sprite Entertainment or providing consent to receive the fax. The suit further notes that the fax did not contain the required “opt-out” notice informing recipients of their right and ability to refuse future faxes.
