Alvarado v. Amsher Collection Services, Inc.
Filed: September 25, 2018 ◆§ 1:18cv5385
Amsher Collection Services allegedly sent to a consumer a collection notice that was not in line with the requirements set forth by the FDCPA.
New York
A Queens, New York consumer has filed a proposed class action in which she alleges Amsher Collection Services, Inc. sent her a collection notice that was not in line with the requirements set forth by the Fair Debt Collection Practices Act (FDCPA).
The case says the February 2018 letter included a statement below a settlement offer that read:
“We are not obligated to renew this offer. Acceptance or rejection of this offer will not affect your right to dispute the validity of this debt or any portion thereof.”
The suit argues that the defendant failed to indicate that acceptance or rejection of the settlement offer would not affect the plaintiff’s right to request the name and address of the original creditor, which could mislead the consumer as to her rights.
