Americollect Inc. and Ermed S.C. are facing a proposed class action lawsuit that alleges the defendants violated several provisions of the Fair Debt Collection Practices Act.
The first plaintiff in the case claims he received three separate collection letters from the defendants that listed varying amounts he supposedly owed for a medical debt. The suit argues that the debt collectors failed to state the amount of the man’s debt in a clear, non-confusing manner and threatened to add interest to his account and report it to credit bureaus without ever taking those actions.
The second plaintiff says he received a collection letter that listed a “Last Activity Date” next to a balance he supposedly owed. The suit takes issue with the defendants’ language, arguing that the debt collectors used “Last Activity Date” to mean the first day that medical services were provided when a consumer would be unsure as to whether the balance listed included charges made on other days.
The third plaintiff claims the defendants offered him a settlement option and demanded payment by a specific date. The complaint argues that the letter would leave the unsophisticated consumer unsure as to whether any payments of less than the settlement amount would be applied to the offer itself or to the full balance of the debt.
