Defendant American Tex-Chem Corporation is on the receiving end of a proposed class action citing alleged violations of the Telephone Consumer Protection Act’s (TCPA) provision meant to prevent nuisance junk faxes. The plaintiff, a company that’s no stranger to initiating litigation over alleged TCPA abuses, claims it received approximately 24 unsolicited junk faxes from the defendant at various times between 2013 and 2014. The case notes the plaintiff reportedly did not give prior express permission to receive the faxes, which were allegedly sent without mandatory opt-out language.
