A proposed class action citing violations of the Telephone Consumer Protection Act has been filed in Connecticut court against defendant American Savings Bank, F.S.B. The complaint claims the defendant used an automatic telephone dialing system to send text messages to proposed class members’ cell phones without first receiving prior express consent. The plaintiff behind the suit claims he had no previous contact or dealings with the defendant before receiving the allegedly unauthorized texts.
