American Chemicals & Equipment, Inc., which operates American Osment, is the defendant in a class action claiming the company violated the TCPA.
American Chemicals & Equipment, Inc., which operates American Osment, is the defendant in a class action claiming the company violated the Telephone Consumer Protection Act (TCPA) by sending out unsolicited faxes that did not contain mandatory opt out language. The complaint argues the defendant sent thousands of junk faxes advertising its supply services that did not contain any opt out notices, which standardly let recipients know what number to call should they wish to stop receiving the faxes.
The case seeks to represent three classes:
- Class A: made up of individuals who received at least one solicited or unsolicited advertisement fax that did not contain an opt-out notice within the last four years
- Class B: made up of anyone who received at least one unsolicited fax from the defendant that did not contain an opt-out notice within the last four years
- Class C: anyone from New York who in the last three years received an unsolicited fax without opt-out language
