Alpha Recovery Corp. and Bureaus Investment Group Portfolio No. 15 face a proposed class action that alleges the agencies failed to properly detail in a collection notice the total nature of the plaintiff’s debt amount.
The lawsuit alleges the defendants failed to provide the plaintiff with enough information that would allow the individual to determine how much needs to be paid to resolve the debt at any given point in time. The complaint attributes this supposed misstep on the defendants’ part to their alleged failure to disclose that the plaintiff’s balance may increase due to added interest and/or late fees, as well as provide a breakdown of the debt with regard to principal and other charges.
The fourth and final count in the complaint centers on language included in the notice in “type-face bigger than the rest of the writing on the letter” that instructed the plaintiff to see the reverse side of the letter for “state specific laws and other important information.” The other side of the notice, according to the suit, contained no information regarding the plaintiff’s Fair Debt Collection Practices Act (FDCPA) rights.
“The manner in which the Letter is formatted would likely make the least sophisticated consumer uncertain as to her rights,” the case argues, noting the notice is structured in such a way that the plaintiff may easily overlook her validation and dispute rights.
