A proposed class action lawsuit filed in New York alleges that Alltran Financial, LP sent a consumer a letter that misrepresented her amount of debt.
According to the suit, the defendant sent the plaintiff a letter in February 2018 regarding an obligation originally owed to American Express. The lawsuit claims the letter stated, in part:
“As of the date of this letter, you owe $788.25.”
The case argues this statement was misleading in that it implied the debt would likely increase, even though the defendant was not authorized to collect any interest or fees.
“Plaintiff was left uncertain as to whether the balance would increase as there was no disclosure that indicated otherwise,” the complaint reads.
