A proposed class action lawsuit has been filed against Alltran Financial, LP over an allegedly misleading collection letter sent to a New York resident.
A proposed class action lawsuit has been filed against Alltran Financial, LP over an allegedly misleading collection letter sent to a New York resident. According to the complaint, the letter contained the following phrase:
“Amount due as of September 29, 2017: $19,212.54.”
The suit takes issue with the defendant’s supposedly deceptive language, claiming the letter suggested the balance would change in the future. The complaint argues that if the plaintiff’s account were not subject to change, the implication in the notice would be false.
Alternatively, if the plaintiff’s account were accruing interest or other fees, the defendant failed to expressly state that his balance was increasing and provide him with enough information to calculate the true balance of his debt, the suit alleges.
