A proposed class action has been filed against Alltran Financial, LP (which the suit notes was formerly known as United Recovery Systems, LP) over claims that it sent a collection letter that failed to comply with the Fair Debt Collection Practices Act (FDCPA). The plaintiff says she received a letter from Alltran that listed her “Current Amount Due” without disclosing whether the amount would increase due to interest or other fees. The suit argues that the defendant’s use of the word “current” implies that the balance will change, but according to the suit, whether the balance is static or not, the defendant was required under the FDCPA to communicate the true amount of the plaintiff’s alleged debt.
