A proposed class action out of New York federal court claims Alltran Financial, LP violated provisions of the Fair Debt Collection Practices Act (FDCPA). The lawsuit takes issue with a collection letter sent by the defendant that allegedly contained unclear language regarding applicable interest and fees on a debt.
The plaintiff received the letter in August 2017 after incurring a debt on an American Express credit card, the lawsuit says. The suit claims that the letter failed to indicate the minimum amount owed, the applicable interest rate, the amount of late fees or when they will be added, and other critical information regarding the individual’s obligation.
