Allstate Insurance Company Settles Phone Call Recording Lawsuit for $3.3 Million

Allstate has agreed to pay $3.3 million to settle a class action that alleged the company illegally recorded cell phone calls with California consumers without their consent.

The settlement, which received preliminary approval from the court in June 2024, covers anyone in California who received at least one call to their cell phone from Allstate’s Claims Liability Determination Unit between February 1 and December 31, 2022 and whose conversation was recorded by Allstate and/or its agent(s) without permission.
To receive a cash payment from the deal, class members must file a timely, valid claim form by mail or through the official Allstate settlement website—TobajianSettlement.com. Claim forms must be submitted by October 30, 2024.

If you’re eligible for a piece of the settlement, the amount you’ll receive will depend on how many other people file claims, among other factors. Compensation will begin to be distributed to consumers after the court grants final approval to the Allstate settlement and any appeals of the deal are resolved.
“Whether the appeals, if any, can be resolved is uncertain, and resolving them can take time, perhaps more than a year,” the settlement site says. “Please be patient.”
A final approval hearing for the settlement is scheduled for January 10, 2025.
The class action lawsuit against Allstate claimed the insurance company ran afoul of California’s Invasion of Privacy Act, a state law that prohibits a party from electronically recording a telephone conversation without consent when the person being recorded is on a cell phone.
