Allied Interstate LLC is the defendant in a proposed class action filed in New York over alleged violations of the federal Fair Debt Collection Practices Act (FDCPA). The case claims the defendant sent the plaintiff a collection notice that unlawfully required the man to dispute his debt in writing.
The FDCPA requires debt collectors to send debtors notice to inform that “unless the consumer, within 30 days of receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed valid.” At no point in this notice, the lawsuit argues, is there a requirement for consumers to dispute a debt in writing.
