Alliant Capital Management, LLC and Oliphant Financial Group, LLC are facing a lawsuit that accuses the debt collectors of failing to disclose to a consumer that the statute of limitations on her alleged obligation had expired.

Alliant Capital Management, LLC and Oliphant Financial Group, LLC are on the receiving end of a proposed class action that accuses the debt collectors of failing to disclose to a consumer that the statute of limitations on her alleged obligation had expired. The woman says she received a collection letter around June 26, 2017, seeking to collect a debt she purportedly owed to Celtic Bank. According to the lawsuit, the defendants neglected to mention in the notice that the debt’s statute of limitations had expired and that neither party could file a lawsuit against the plaintiff to collect. Further, the case claims the defendants also failed to inform the plaintiff that any partial payment could renew the statute of limitations and subject her to more aggressive collection methods.
"This is a material omission that threatens the consumer's rights and attempts to coerce payment from the consumer," the complaint states.
