A Florida resident has filed a proposed class action against Allen, Miller & Greene, LLC over alleged violations of the Fair Debt Collection Practices Act (FDCPA).
A Florida resident has filed a proposed class action against Allen, Miller & Greene, LLC over alleged violations of the Fair Debt Collection Practices Act (FDCPA). The plaintiff claims the company mailed her a collection notice in February 2018 in which it failed to disclose that in order to invoke her FDCPA rights, she would need to notify Allen, Miller & Greene that the debt is disputed. The complaint adds the defendant also failed to state in the notice the identity of the plaintiff’s current creditor.
“As such, a false and misleading statement was made due to the omission,” the lawsuit reads.
