The 16-page privacy lawsuit was filed by a woman who claims to have been “harassed for months” by the nonprofit corporation, which provides student loan and higher education financing services. The suit contends that since October 2022, MOHELA has placed numerous robocalls to the plaintiff’s cell phone without prior authorization, in violation of the federal Telephone Consumer Protection Act (TCPA).
Per the case, the TCPA expressly prohibits placing non-emergency calls using an artificial or prerecorded voice without first obtaining the recipient’s consent.
The complaint says the plaintiff sent a demand letter to MOHELA in April 2023, but the organization continued to call her through mid-May of that year.
According to the filing, the plaintiff has no prior relationship with MOHELA and never provided her permission to be contacted.
The woman says the alleged robocalls inconvenienced her, disrupted her daily life and invaded her privacy.
The lawsuit looks to represent anyone in the United States who, in the past four years, received any prerecorded solicitation or telemarketing phone calls from MOHELA on their cell phone and has not previously consented to being contacted by the defendant.
