The 12-page privacy lawsuit was filed by a man who claims Sirius XM left at least five prerecorded voice messages on his cell phone between May and July 2021 without his authorization and in violation of the federal Telephone Consumer Protection Act (TCPA).
According to the suit, the TCPA precludes companies from placing non-emergency calls using an artificial or prerecorded voice without first obtaining the recipient's express permission.
The plaintiff says he has no prior relationship or account with Sirius XM and never provided his consent to be contacted.
The man contends that the alleged robocalls, which were purportedly intended for someone else, were a nuisance and an invasion of privacy.
The lawsuit looks to represent anyone in the United States who has never subscribed to Sirius XM and to whose cell phone the company placed a call using an artificial or prerecorded voice at any time in the past four years.
