Alleged Robo-Texts Come Back to Bite Detroit Trading Services in Class Action Suit
Roudant v. Detroit Trading Services, Llc
Filed: May 21, 2018 ◆§ 1:18cv2315
A consumer claims Detroit Trading Service sent out unlawful automated text messages despite never obtaining consent to do so.
Georgia
Detroit Trading Services, LLC is the defendant in a proposed class action in which the plaintiff claims the automotive marketing company sent unlawful automated text messages to consumers’ cell phones. Alleging violations of the Telephone Consumer Protection Act (TCPA), the plaintiff says she received at least two texts from the defendant in late May 2017 in which the company thanked her for signing up for its “auto program.” The issue, the case claims, is the plaintiff never signed up for the defendant’s services nor provided Detroit Trading Services with her cell phone number. According to the complaint, the defendant sent the texts by way of an automatic dialing system, evident by the messages’ “non-personalized nature.”
