The 10-page lawsuit says that by continuing to send promotional texts to the plaintiff and other individuals after they have opted out, L’Oréal has violated the Telephone Consumer Protection Act, which was established to protect consumers from unwanted sales calls or text messages.
According to the case, L’Oréal has failed to maintain an internal do-not-call list, establish a written policy with regard to telemarketing and provide adequate training to staff in marketing positions.
In the plaintiff’s experience, even after the woman replied “stop” numerous times, the company continued to send texts to her cell phone, the suit relays. As the complaint tells it, this “illegal conduct” has caused the “invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.”
The lawsuit looks to represent anyone in the United States who, since April 24, 2019, received to their residential phone numbers a promotional text message from L’Oréal after making a request to stop receiving texts.
