Alleged Chrysler Capital Robocalls Trigger Class Action

A class action lawsuit has been filed against Chrysler Capital by a consumer who claims he received at least 50 robocalls from the company between May and December 2022.

A proposed class action lawsuit has been filed against Chrysler Capital by a consumer who claims to have received at least 50 robocalls from the company between May and December 2022.
According to the 10-page complaint, Santander Consumer USA, Inc., who does business as Chrysler Capital, has run afoul of the Telephone Consumer Protection Act, which protects people from the “harassment” and “invasion of privacy” related to unwanted robocalls.
Per the lawsuit, the plaintiff, a Nevada resident, received unsolicited calls from Chrysler Capital on at least 50 occasions since May, despite repeatedly requesting to be removed from the company’s system and consistent assertions that they had the wrong number.
The case alleges, however, that the man’s appeals “fell on deaf ears” as the company continued to call his cellphone number in the days and weeks that followed.

The suit says that Chrysler Capital, which provides nationwide financial services to auto-dealers, and its third-party affiliates have repeatedly called the plaintiff and addressed someone of a different name who he did not know. The filing says that when the plaintiff answered a call, he was “greeted with an artificial and/or prerecorded voice” before being transferred to a company representative.
The complaint relays that on numerous occasions, the plaintiff informed the representative of the mistaken call, requested that his number be erased from the system, and was assured that he would be removed from the list.
The filing charges, however, that his requests were “blatantly ignore[d]” as the company “continued pounding” the man with robocalls. The case contends that the defendants’ “invasive” actions have “disrupted Plaintiff’s everyday life.”
The lawsuit looks to represent anyone in the United States whose cellphone was called without consent by Chrysler Capital’s automated system and in connection with someone else’s account at any time since December 2018.
