Georgia law firm Aldridge Pite Haan, LLP is on the receiving end of a proposed class action filed in Wisconsin that claims it acted improperly when attempting to collect consumer debts. Citing alleged violations of the Fair Debt Collection Practices Act (FDCPA), the lawsuit claims the defendant, which doubles as a “high volume” debt collector, sent the plaintiff a collection notice over a medical services debt that “as a whole is confusing and misleading to the unsophisticated consumer.”
The plaintiff claims the defendant’s collection notice, which included the word “law” on the letterhead, falsely implies an attorney was meaningfully involved in the collection of certain accounts. The complaint argues the unsophisticated consumer could be led to believe that a law firm had been hired to sue him or her since no prominent disclaimer exists stating otherwise in the notice.
