According to the 18-page lawsuit, the product is explicitly represented as containing pure avocado oil, and “refined avocado oil” is listed as the only ingredient in the 17-fluid-ounce bottle. Contrary to this “unequivocal” representation, independent testing has determined that the product, in fact, contains other undisclosed oils, the filing claims.
Indeed, a recent study conducted by the University of California at Davis revealed that ALDI was one of several major retailers whose avocado oil products were “adulterated” with high levels of cheaper ingredients such as oleic sunflower or safflower oils, the suit shares.
The case charges that the alleged misrepresentation misleads reasonable consumers into thinking the item is made with only pure avocado oil, which, according to the complaint, is considered one of the healthiest cooking oils because of its links to reduced blood pressure, cholesterol, blood sugar and joint pain, among other health benefits.
The filing asserts that whether the product is pure or adulterated is material to shoppers, who reasonably expect to be able to discern from product packaging exactly what type of oil they are buying and consuming.
As the class action lawsuit tells it, ALDI consumers would not have paid as much for the avocado oil, or bought it at all, had they known it was adulterated with other oils.
The ALDI avocado oil suit looks to represent anyone who purchased the product in the United States within the applicable statute of limitations period.
