Albertsons Companies LLC is facing a proposed class action alleging the company sent unsolicited text message advertisements to consumers in violation of the Telephone Consumer Protection Act (TCPA). The defendant, according to the complaint, operates “the second-largest supermarket chain in North America” and uses automated dialing technology to send consumers marketing text messages promoting its goods and services. The plaintiff claims she received a text from the defendant urging her to click the included link to sign up for the company’s “Just for U” and “Gas Rewards” services. She argues that she never provided her consent to receive the text and was not offered any way to opt-out of receiving future messages. The text, the case alleges, invaded the plaintiff’s privacy and caused her to become “distracted and aggravated.”
