The 12-page lawsuit says that despite the front-label claim that the Ajax bottle contains enough detergent for 40 loads, the usage instructions found on the back label amid a “wall of multi-colored graphics, icons, warnings and ingredients” indicate that this number can be achieved only when washing medium loads, for which the cap is filled “halfway between lines 1 and 2.”
As the suit tells it, studies reveal that a majority of households routinely wash large or very large loads of laundry, which the detergent’s back label shows would require filling the cap to line three. The product’s label is misleading because a typical household will therefore get no more than 20 loads out of the Ajax detergent, the case alleges.
The defendant is able to sell the product at a premium price of $4.99 for 60 ounces thanks to these alleged misrepresentations, the complaint claims.
The plaintiff, a Chicago resident, has purchased the Ajax detergent in the last two years and believed, based on the product’s representations, that it would last for 40 typically full loads of laundry, the filing relays. However, the woman was only able to do roughly half as many loads as she was led to expect, the suit says. Had the plaintiff known the detergent would only suffice for around half as many loads as represented, she would not have paid as much for it or bought it at all, the case claims.
The lawsuit looks to represent anyone residing in Illinois, South Dakota, Wyoming, Idaho, Alaska, West Virginia, Arkansas, North Carolina or Utah who purchased Radienz Living Chicago’s Ajax detergent within the applicable statutes of limitations period.
