A $5 million proposed class action alleges defendants Air Evac Lifeteam and Air Evac EMS, Inc. reneged on a contractual agreement they had with the plaintiff.
A $5 million proposed class action alleges defendants Air Evac Lifeteam and Air Evac EMS, Inc. reneged on a contractual agreement they had with the plaintiff to waive any air transportation costs not covered by her insurance.
According to the 16-page lawsuit, the plaintiff was severely injured in a car accident in December 2009 and had to be transported by Air Evac to a Huntsville, Alabama hospital. The woman’s original contract for emergency air transportation, as well as her 2008 renewal, with the defendants reportedly read, in part:
“As a member, Air Evac Lifeteam will work on your behalf with your insurance company to secure payment for its flight. For all Air Evac Lifeteam transport costs that exceed any insurance or medical benefits you may have, the company will waive costs not covered by your insurance or benefits.”
The case says the plaintiff’s insurance covered its share of the cost of the air transport provided by Air Evac, yet the defendants allegedly continued to bill the plaintiff for the balance “in direct contravention” to the terms of the parties’ agreement.
