Agentra, LLC is facing a proposed class action alleging the company violated the Telephone Consumer Protection Act by placing automated telemarketing calls to consumers’ cell phones without first obtaining prior express consent.
Agentra, LLC is facing a proposed class action alleging the company violated the Telephone Consumer Protection Act by placing automated telemarketing calls to consumers’ cell phones without first obtaining prior express consent. The plaintiff in the case says he received a pre-recorded voicemail on his cell phone advertising the defendant’s health insurance products. According to the case, the plaintiff received the call despite his number's inclusion in the National Do Not Call Registry for more than a year prior. The man argues that he never provided the defendant with his consent to receive the call and had no prior business relationship with the company. The case further alleges that the call was placed using automated dialing technology and wasn’t made for emergency purposes – a telemarketing practice the suit argues is not permitted under the TCPA.
