Afni Hit with Class Action Over June 2021 Data Breach Impacting Over 261K Consumers

Afni has been hit with a lawsuit over a June 2021 data breach during which the personal information of more than 261,000 individuals was reportedly compromised.

Afni, Inc. has been hit with a proposed class action lawsuit over a June 2021 data breach during which the personal information of more than 261,000 individuals was reportedly compromised.
The 34-page case alleges Afni, who provides customer service assistance to clients, discovered on June 7, 2021 “suspicious activity” on its systems and, after an investigation, determined that the names, Social Security numbers and birth dates of roughly 261,449 consumers may have been exposed to unauthorized access.
The lawsuit claims Afni “betrayed the trust” of affected consumers by failing to take reasonable steps to safeguard their information.
“Defendant’s actions represent a flagrant disregard of the rights of the Class Members, both as to privacy and property,” the complaint scathes.
Per the case, victims whose information was compromised in the breach will face a heightened risk of identity theft for the rest of their lives as a result of Afni’s failure to protect its systems.
“Due to Defendant’s negligence, cyber criminals obtained everything they need to commit identity theft and wreak havoc on the financial and personal lives of hundreds of thousands of individuals.”
The lawsuit relays that although Afni discovered the data breach in June 2021, the company waited over a year, until July 2022, to begin notifying those whose information was compromised. Moreover, the defendant’s data breach notice failed to disclose “exactly what information was exposed,” the suit says.
The case argues that if Afni had been more diligent in investigating and reporting the data breach, victims could have taken steps to protect themselves sooner and mitigate the damage caused by the incident.
The lawsuit looks to represent anyone Afni has identified as among those who were impacted by the data breach, including individuals who were sent notice of the breach.
