Advantage Imaging, LLC is facing a class action out of Ohio claiming the diagnostic imaging company sent out unsolicited junk advertisement faxes that did not include Telephone Consumer Protection Act (TCPA)-mandated opt-out language. The plaintiff, Spine & Sports Chiropractic, Inc., claims it never gave prior permission to receive the faxes, and that at least 25 other recipients received the same fax advertisements. The defendant’s junk faxes, the complaint says, advertised a new open MRI machine and invited recipients to an open house at its new location.
