The 29-page lawsuit says the healthcare management company first detected unusual activity on its computer systems on May 11 of this year, and a subsequent investigation revealed that an unauthorized third party had gained access to the network between May 10 and May 13.
The suit relays that the private information compromised in the breach included individuals’ names, addresses, Social Security numbers, emails, dates of birth and driver’s license details. Per the case, certain medical data was also exposed, such as individuals’ treatment or diagnosis information, provider names, dates of service, guarantor ID details, policy numbers and health insurance and treatment cost information.
The complaint argues that the cyberattack was a direct result of AMM’s “grossly negligent—indeed, reckless—failure” to comply with industry standards and implement reasonable data security measures to safeguard consumers’ personal information.
The Baltimore-based defendant, which provides management services to healthcare entities across the country, also failed to promptly notify data breach victims of the unauthorized disclosure of their information, the filing claims.
As a result of AMM’s negligence, the lawsuit charges, cybercriminals “now possess everything they need to commit personal identity theft and wreak havoc on the financial and personal lives of more than 319,000 individuals, for decades to come.”
The plaintiff, a Maryland resident who sought medical services with one of the defendant’s healthcare clients, received notice on June 29, 2023 informing her that her private information had been compromised in the breach, the suit says. Like other victims, the woman is now at a greater risk of “crippling future identity theft and fraud” as a result of AMM’s conduct, the case contends.
The plaintiff is not alone in her efforts to take action against AMM, as at least two other cases have been filed out of Maryland concerning similar allegations. The other complaints were filed just days before this case was submitted, on July 13 and July 14 of this year.
The lawsuit detailed on this page looks to represent anyone in the United States whose personal information was compromised as a result of the Advanced Medical Management data breach that occurred in May 2023.
